Alerti Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Alerti mobile application and related services (collectively, the "Service") provided by SyncTechno Inc. ("Alerti," "we," "us," or "our"). PLEASE READ THESE TERMS CAREFULLY. BY DOWNLOADING, INSTALLING, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. Acceptance of Terms

1.1 By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1.2 If you are using the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" refers to that entity.

1.3 We may update these Terms from time to time. When we make material changes, we will notify you at least thirty (30) days before they take effect via in-app notice, push notification, or email. For non-material changes, we will notify you at least seven (7) days in advance. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and delete your account.

2. Eligibility

2.1 Minimum Age. You must be at least fourteen (14) years of age to use the Service. We do not knowingly allow individuals under the age of fourteen (14) to register for or use the Service. If we discover that an account belongs to a user under 14, we will suspend the account immediately and delete the associated personal data.

2.2 You represent and warrant that:

  • (a) you are at least 14 years old;
  • (b) you have the legal capacity to enter into these Terms;
  • (c) you are not barred from using the Service under any applicable law;
  • (d) all information you provide is accurate and current.

2.3 If you are between 14 and the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account

3.1 Authentication. Account creation requires authentication via Google OAuth. Apple Sign-In and other authentication methods may be added in future versions.

3.2 Account Responsibility. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

  • (a) keep your authentication credentials secure;
  • (b) immediately notify us of any unauthorized access to your account;
  • (c) ensure that all information associated with your account is accurate.

3.3 We are not liable for any loss or damage arising from your failure to comply with this Section, except to the extent caused by our willful misconduct or gross negligence.

3.4 Account Termination. You may terminate your account at any time through the in-app account deletion option. We reserve the right to suspend or terminate accounts as set out in Section 13.

4. Description of Service

4.1 Core Function. Alerti is a real-time information service that delivers earthquake and tsunami alerts to users based on their geographic location, derived from data published by third-party authorities.

4.2 Location Routing. The Service determines whether to send an alert to you based on the geographic overlap between (i) the affected area reported by the third-party data source and (ii) your last-known location, encoded as an H3 hexagonal cell index. We do not store your precise GPS coordinates server-side; we operate on H3 cell granularity.

4.3 Safety Reporting ("I'm Safe"). You may use the in-app "I'm Safe" feature to indicate your safety status during or after a disaster event. This feature is voluntary and does not constitute a request for emergency assistance.

4.4 Alert Severity. Alerts may be classified as "CRITICAL" or "ADVISORY" based on the magnitude, intensity, and proximity of the event relative to your location. Tsunami alerts are always classified as CRITICAL.

4.5 No Generation of Data. The Service does not generate, measure, or independently verify earthquake or tsunami data. The Service consumes, transforms, and redistributes data from external authorities as listed in Section 5.

5. Data Sources and Attribution Disclaimer

5.1 The Service relies exclusively on data published by external governmental and intergovernmental authorities (the "Data Sources"), including without limitation:

  • Korea Meteorological Administration (KMA) β€” earthquake and tsunami data for the Republic of Korea
  • Japan Meteorological Agency (JMA) β€” earthquake and tsunami data for Japan and surrounding regions
  • U.S. Geological Survey (USGS) β€” global earthquake catalog
  • Central Weather Administration of Taiwan (CWA) β€” earthquake and tsunami data for Taiwan
  • Pacific Tsunami Warning Center (PTWC) β€” tsunami warnings for the Pacific basin

5.2 Data Sources may be added, removed, or replaced at any time. The current set of Data Sources will be displayed in the Service or in our published documentation.

5.3 DISCLAIMER:

ALERTI REDISTRIBUTES DATA PUBLISHED BY THIRD-PARTY AUTHORITIES INCLUDING THE KOREA METEOROLOGICAL ADMINISTRATION (KMA), JAPAN METEOROLOGICAL AGENCY (JMA), U.S. GEOLOGICAL SURVEY (USGS), CENTRAL WEATHER ADMINISTRATION OF TAIWAN (CWA), AND PACIFIC TSUNAMI WARNING CENTER (PTWC). ALERTI DOES NOT CONTROL, GENERATE, OR INDEPENDENTLY VERIFY THE UNDERLYING DATA AND DISCLAIMS ALL WARRANTIES REGARDING ITS ACCURACY, TIMELINESS, OR COMPLETENESS.

5.4 Each alert displayed in the Service identifies the originating Data Source. You are encouraged to consult the official publication of the relevant Data Source for authoritative information.

6. No Warranty

6.1 DISCLAIMER OF WARRANTIES:

ALERTI MAKES NO WARRANTY THAT EARTHQUAKE OR TSUNAMI ALERTS WILL FUNCTION AT ALL TIMES, IN ALL GEOGRAPHIC AREAS, BE UNINTERRUPTED, BE ERROR-FREE, OR THAT ANY ERRORS WILL BE CORRECTED. ALERTS MAY BE DELAYED, INACCURATE, OR FAIL TO ARRIVE.

6.2 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

6.3 We do not warrant that:

  • (a) the Service will meet your requirements;
  • (b) the Service will be uninterrupted, timely, secure, or error-free;
  • (c) any defects in the Service will be corrected;
  • (d) the Service is free of viruses or other harmful components.

6.4 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

7. User Assumption of Risk

7.1 ASSUMPTION OF RISK:

YOU BEAR AND EXPRESSLY ASSUME ALL RISK ASSOCIATED WITH HOW YOU RESPOND TO INFORMATION PROVIDED (OR NOT PROVIDED) BY THE APP, INCLUDING WITHOUT LIMITATION ALL RISK ASSOCIATED WITH INACCURATE NOTIFICATIONS AND/OR UNTIMELY AND/OR LATE NOTIFICATIONS. UPON RECEIVING AN ALERT, YOU SHOULD IMMEDIATELY TAKE PROTECTIVE ACTION (e.g., DROP, COVER, AND HOLD ON FOR EARTHQUAKES; MOVE TO HIGH GROUND FOR TSUNAMIS).

7.2 You acknowledge and agree that:

  • (a) earthquake P-waves may arrive at your location before or simultaneously with an alert, especially near the epicenter;
  • (b) network conditions, device settings (e.g., Do Not Disturb, battery saver, notification permissions), and operating-system policies may delay or suppress alerts;
  • (c) you are responsible for understanding the safe-action protocols for your environment (e.g., evacuation routes, the location of structurally safe spots);
  • (d) the Service is not a life-support, safety-critical, or fail-safe system and must not be relied upon as the sole source of disaster information.

8. Not a Substitute for Official Emergency Services

8.1 NOT A SUBSTITUTE:

Alerti is a supplementary information service. It is NOT a substitute for official emergency services, government-issued disaster alerts (e.g., Korea's CBS Cell Broadcast, Japan's J-Alert, U.S. Wireless Emergency Alerts), or 119/911 emergency response. In an emergency, contact official emergency services directly.

8.2 You acknowledge that the Service does not replace and is not designed to replace:

  • (a) Korea's national CBS Cell Broadcast Service operated by the Ministry of the Interior and Safety;
  • (b) Japan's J-Alert (ε…¨ε›½ηž¬ζ™‚θ­¦ε ±γ‚·γ‚Ήγƒ†γƒ );
  • (c) the United States Wireless Emergency Alerts (WEA) system;
  • (d) any other official government-issued disaster warning system in your jurisdiction;
  • (e) emergency telephone services such as 119 (Korea, Japan), 911 (United States), 112 (EU), or any equivalent.

8.3 In any emergency, you must contact official emergency services directly using the appropriate emergency telephone number for your jurisdiction.

9. Background Location Limitation (Version 1.0)

9.1 VERSION 1.0 LIMITATION: The current version of the Service (v1.0) updates your location only while the app is actively running in the foreground. The app does not perform background location tracking when terminated, suspended, or running in the background.

9.2 As a result:

  • (a) if a disaster occurs while the app is not running, alert routing will be based on your last-known location at the time the app was last active;
  • (b) if you have moved since the app was last active, you may receive alerts that are not relevant to your current location, or fail to receive alerts that would have been relevant to your current location;
  • (c) the Service cannot guarantee location-accurate alerts when the app has not been recently launched.

9.3 We may introduce opt-in background location tracking in a future version. Such functionality will require your express consent and a corresponding update to these Terms and our Privacy Policy.

10. User Conduct

10.1 You agree not to use the Service to:

  • (a) violate any applicable law, regulation, or third-party right;
  • (b) impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • (c) submit false, misleading, or fraudulent information, including false safety reports;
  • (d) interfere with or disrupt the Service, servers, or networks connected to the Service;
  • (e) attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems connected to the Service;
  • (f) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, except to the extent expressly permitted by applicable law;
  • (g) use any robot, scraper, or other automated means to access the Service without our prior written permission;
  • (h) circumvent, disable, or otherwise interfere with security-related features of the Service;
  • (i) use the Service for commercial purposes without our prior written consent;
  • (j) provide false location data (e.g., GPS spoofing) for the purpose of disrupting alert routing;
  • (k) submit false "I'm Safe" reports or impersonate the safety status of another person.

10.2 We reserve the right to investigate and take appropriate action against any user who, in our sole discretion, violates this Section, including suspending or terminating accounts and reporting violations to law enforcement.

11. Limitation of Liability

11.1 EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, to the maximum extent permitted by applicable law:

  • (a) IN NO EVENT SHALL ALERTI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR DATA SOURCES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE;
  • (b) IN NO EVENT SHALL ALERTI'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (i) THE AMOUNT YOU HAVE PAID TO ALERTI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) FIFTY UNITED STATES DOLLARS (USD 50).

11.2 THE LIMITATIONS IN THIS SECTION APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.3 Statutory Rights. Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties. To the extent that applicable mandatory law in your jurisdiction (including, where applicable, the laws of the Republic of Korea governing willful misconduct or gross negligence) prohibits any of the limitations in this Section, those limitations shall not apply to you, and Alerti's liability shall be limited to the smallest extent permitted by such law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11.4 Korean Users. For users residing in the Republic of Korea, Alerti's liability for damages caused by Alerti's willful misconduct or gross negligence is governed by the Korean Act on the Regulation of Terms and Conditions and other applicable Korean law, and the limits in Section 11.1(b) do not apply to such cases.

12. Indemnification

12.1 You agree to defend, indemnify, and hold harmless Alerti, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • (a) your use of or access to the Service;
  • (b) your violation of these Terms;
  • (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right;
  • (d) any false, misleading, or fraudulent content you submit through the Service, including false safety reports.

12.2 We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

13. Termination

13.1 Termination by You. You may terminate your account at any time through the in-app account deletion option or by contacting alerti@synctechno.com.

13.2 Termination by Alerti. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including without limitation if we believe that:

  • (a) you have violated these Terms;
  • (b) you have provided false or misleading information;
  • (c) you are under the age of 14;
  • (d) your conduct creates risk or possible legal exposure for us, other users, or third parties;
  • (e) we are required to do so by law.

13.3 Effect of Termination. Upon termination:

  • (a) your right to access and use the Service immediately ceases;
  • (b) we will handle your personal data in accordance with our Privacy Policy and applicable law;
  • (c) Sections that by their nature should survive termination (including Sections 5, 6, 7, 8, 11, 12, 13.3, and 14) will survive.

14. General

14.1 Governing Law

These Terms and any dispute arising out of or relating to the Service are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14.2 Dispute Resolution and Jurisdiction

(a) Korean Users. For users residing in the Republic of Korea, any dispute arising out of or relating to these Terms or the Service that is not resolved through good-faith negotiation shall be subject to the jurisdiction of the courts of the Republic of Korea, in accordance with Korean civil procedure law. The court of the user's place of residence (or, where no place of residence exists, the user's place of stay) and the Seoul Central District Court shall both have jurisdiction.

(b) Non-Korean Users. For users residing outside the Republic of Korea, any dispute that is not resolved through good-faith negotiation shall be submitted to the Seoul Central District Court as the court of first instance, unless otherwise required by mandatory law in the user's jurisdiction.

(c) Optional Arbitration (Non-Korean Users). Where permitted by applicable law and at the option of the parties, disputes involving non-Korean users may be resolved by binding arbitration administered by a mutually agreed arbitral institution, with the seat of arbitration in Seoul, Republic of Korea, and proceedings conducted in English.

14.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

14.4 No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.

14.5 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.

14.6 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Alerti regarding the Service and supersede all prior agreements.

14.7 Force Majeure

We shall not be liable for any failure or delay in performance to the extent caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, shortages of transportation facilities, fuel, energy, labor, or materials.

14.8 Changes to These Terms

We reserve the right to update these Terms as set out in Section 1.3. The "Last Updated" date at the top of this document indicates the most recent revision.
